Exhibitor Agreement

Presented by the San Joaquin Clay & Glass Association (SJCGA)

Event Hours: 10:00AM - 3:00PM

The SJCGA Clay & Glass Festival is an outdoor, retail market festival featuring original, handcrafted work by independent clay and glass artists and makers. By applying and accepting a booth assignment, the Exhibitor agrees to the following terms.

1. Exhibitor Acceptance & Booth Assignments

All artists and makers are welcome to apply. New Exhibitors will be asked to provide photographs of their work with their application so SJCGA can confirm that their work is a good fit for the Clay & Glass Festival. Returning Exhibitors receive priority for booth assignments, followed by new Exhibitors. SJCGA will make reasonable efforts to accommodate location requests but cannot guarantee specific booth locations..

SJCGA may adjust assignments as needed for safety, accessibility, electrical requirements, neighboring Exhibitors, or event logistics. Booth assignments are not transferable and are not guaranteed with receipt of payment. If SJCGA is unable to provide a booth assignment, the Exhibitor will receive a refund.

2. Artwork & Products

All work must be original, handcrafted work created by the Exhibitor.

Every item for sale or on display must be primarily made from fired clay or glass. Other materials may be incorporated into a piece, but ceramics or glass must be the primary material of the finished work.

This is a retail marketplace. Exhibitors must have a meaningful selection of completed work available for purchase. Booths may not be used primarily to display samples or work available only by commission. Commissioned work may be offered in addition to work available for immediate purchase.

3. Booth Responsibilities

Exhibitors provide their own booth equipment and displays.

Exhibitors are responsible for setup, display, sales, payment collection, customer service, and removal of all personal property. Booths must remain neat, professional, safe, and accessible.

Displays may not obstruct walkways, exits, emergency access, or neighboring booths. Exhibitors may not dismantle their booth before the official end of the festival.

4. Payment, Sales Tax & Commission

Booth fees must be paid at the time of registration. Space is not confirmed until payment is received.

All Exhibitors must have a valid California seller's permit issued by the California Department of Tax and Fee Administration (CDTFA), as required by law. Exhibitors are responsible for collecting, reporting, and remitting all applicable sales tax on their sales. SJCGA is not responsible for an Exhibitor's sales tax obligations.

In addition to the booth fee, Exhibitors must pay SJCGA a 10% commission on gross festival sales. The commission is due immediately following the event, unless another arrangement has been approved in advance.

5. Cancellation Policy

Cancellation Deadline: November 1, 2026

Booth fees are non-refundable after the cancellation deadline. No refunds or credits will be issued for cancellations, no-shows, illness, personal circumstances, weather, or other circumstances outside SJCGA's control.

Exhibitors who need to cancel should notify SJCGA as soon as possible. Failure to notify SJCGA of a cancellation may affect eligibility for future festivals.

6. Insurance & Liability

Exhibitors are responsible for insurance covering their artwork, merchandise, equipment, displays, and personal property.

SJCGA, its officers, board members, volunteers, agents, representatives, and event partners are not responsible for loss, theft, damage, or injury arising from participation, except when caused by SJCGA's gross negligence or willful misconduct.

7. Safety, Laws & Conduct

Exhibitors must comply with all applicable laws, permits, fire codes, health and safety requirements, and venue rules.

Exhibitors are expected to conduct themselves professionally and respectfully. SJCGA may remove any exhibit, product, signage, or behavior it considers unsafe, offensive, disruptive, or inconsistent with the festival.

Violations may result in removal without refund and exclusion from future events.

8. Cancellation & Unforeseen Circumstances

The SJCGA Clay & Glass Festival will take place rain or shine. Weather conditions will not constitute grounds for an Exhibitor cancellation or refund if SJCGA has not officially cancelled the event.

SJCGA may cancel, postpone, modify, or interrupt the festival due to circumstances beyond its reasonable control, including severe weather, fire, natural disaster, government orders, venue restrictions, utility failures, or other unforeseen circumstances.

If SJCGA officially cancels or postpones the event, refunds, credits, or transfers will be determined by the SJCGA Board based on the circumstances.

An Exhibitor who chooses not to attend due to weather or other personal circumstances is not entitled to a refund if the festival has not been officially cancelled by SJCGA.

9. Photography & Promotion

Photographs and video may be taken during the festival and used by SJCGA for promotional, educational, archival, website, social media, advertising, and future festival marketing purposes without additional compensation.

10. Agreement

This agreement and the Exhibitor application constitute the complete agreement regarding participation in the festival. The Exhibitor acknowledges that they have read, understood, and agree to these terms.
